General Terms and Conditions of Sale

1. Legal information

Luxoria Travels is a private travel concierge service operated by T.E.M&CO SCOMM, a limited partnership registered in Belgium under company number BE1024.317.525, whose registered office is located at Rue du Long Chêne n°46, 1970 Wezembeek-Oppem, Belgium.

2. Purpose and scope

These General Terms and Conditions of Sale (GTC) govern the relationship between Luxoria Travels (hereinafter “the Agent”) and any natural or legal person (hereinafter “the Client”) requesting a concierge, organisation or travel assistance service.

Luxoria Travels acts as an intermediary agent between the Client and tourism service providers (hotels, airlines, local agencies, transfers, etc.).

It does not constitute a travel agency within the meaning of Directive (EU) 2015/2302.

Any request addressed to Luxoria Travels constitutes unreserved acceptance of these Terms and Conditions.

3. Nature of services

Luxoria Travels offers, among other things:

  • research, recommendation and selection of accommodations, flights, transfers and experiences;
  • the management and coordination of bookings with partner service providers;
  • the management and coordination of bookings with partner service providers;

Final service contracts (accommodation, transport, activities) are established between the Client and third-party suppliers, with Luxoria Travels acting solely as an intermediary responsible for connecting and paying.

Air transport and accommodation services are booked separately.

Each service is subject to a separate contract with the relevant supplier, even when Luxoria Travels coordinates it on behalf of the Client.

Therefore, no combined offer of the “package holiday” type is marketed by Luxoria Travels.

4. Role and mandate of Luxoria Travels

By accepting a proposal, the Client expressly authorizes Luxoria Travels to:

  • to reserve the desired services on his/her behalf;
  • collect the amounts due and make the payment to suppliers on behalf of the Client;
  • collect intermediary commissions paid by partner service providers.

The funds received by Luxoria Travels are used exclusively for booking the services confirmed and do not constitute a deposit or savings product.

Luxoria Travels retains the right to invoice its fees or commissions according to the terms specified in the quote.

5. Payment

The total payment due from the Client includes:

  • the amount of services booked with suppliers,
  • and, where applicable, any service charges or management fees agreed upon in advance.

Payment is made according to the terms specified in the invoice or quote provided.

No reservation will be confirmed without full payment.

Payments can be made by bank transfer to the account of T.E.M&CO SCOMM – Luxoria Travels, whose details are shown on the quote.

Luxoria Travels undertakes to transfer the amounts due to the service providers within the agreed timeframes.

In the event that a reservation cannot be made (e.g., hotel is fully booked after payment), the corresponding amount will be fully refunded to the Client, less any bank charges.

6. Cancellations and modifications

Any request for cancellation or modification must be submitted in writing (email).

The applicable conditions are those of the third-party providers (hotels, airlines, etc.), which Luxoria Travels will communicate to the Client before validation.

Cancellation or modification fees are the responsibility of the Client and may vary according to the provider's rules.

Luxoria Travels is not responsible for refusals or delays in reimbursement decided by suppliers.

7. Responsibility

Luxoria Travels acts as an intermediary agent and not as the provider of the services sold.

Its liability cannot be invoked in the event of:

  • defect or poor performance attributable to service providers;
  • force majeure (strike, weather, government decision, etc.);
  • loss, theft or damage suffered during the trip;
  • error or incomplete information provided by the Client.

Luxoria Travels undertakes, however, to intervene diligently to facilitate any dispute resolution between the Client and the service provider.

8. Personal data

Luxoria Travels processes the Client's personal data in the context of the preparation, management and monitoring of its services, in accordance with the General Data Protection Regulation (EU 2016/679).

9. Intellectual property

All content, texts, visuals and trademarks of Luxoria Travels are the exclusive property of T.E.M&CO SCOMM.

Toute reproduction, diffusion ou exploitation non autorisée est strictement interdite.

10. Applicable law and jurisdiction

These Terms and Conditions are governed by Belgian law.

Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the French-speaking courts of Brussels, unless otherwise provided by mandatory law.

Compliance with European and Belgian law

Luxoria Travels – operated by T.E.M&CO SCOMM – acts in accordance with European Regulation (EU) 2016/679 on the protection of personal data (GDPR) as well as with Belgian legislation on electronic commerce, tourism and consumer protection.

These General Terms and Conditions of Sale and the Privacy Policy comply in particular with:

  • Directive (EU) 2015/2302 on package travel and linked travel arrangements,
  • Belgian Law of 21 December 2013 relating to the protection of consumers in the context of distance contracts,
  • and the Belgian Code of Economic Law, Book VI (Market Practices and Consumer Protection).

Luxoria Travels acts as a private concierge and mandated intermediary, and not as a travel agency within the meaning of the aforementioned directive.

Each service is contracted separately with partner suppliers in accordance with European regulations.
